Terms of Service

Wombato is an interactive map and community for lovers of wild camping, vanlife and outdoor travel. These terms describe the rules for using the service. By creating an account or using Wombato, you accept these rules.

1. General provisions

1.1. Definitions

  • Service - the Wombato platform available at wombato.com.
  • User - a person using the Service who is at least 16 years old.
  • Account - the User's individual panel available after registration and login.
  • Content - materials posted by the User: place descriptions, photos, reviews, comments, check-ins and posts in the community feed.
  • Places - locations described by Users as suitable for camping, campsites or overnight stays.

1.2. Service operator

The operator of the Service and the entity providing services electronically is Kamil Grabowski, address: ul. Bydgoska 6, 30-056 Kraków, Poland, NIP: 6612220368, REGON: 260231175. Contact: support@wombato.com.

1.3. Acceptance of the Terms

Starting to use the Service means you accept these Terms. Data processing is described in the Privacy Policy, which forms part of the Terms. If you do not accept the Terms, stop using the Service.

2. Rules for using the Service

2.1. Purpose of the Service

Wombato is a community platform that lets you:

  • find and share information about places to camp,
  • publish reviews and photos,
  • build a community of outdoor lovers and exchange experiences,
  • use location-based features (filtering nearby places) - with your consent and without storing a location history.

2.2. Requirements for Users

  • at least 16 years old,
  • providing true and up-to-date data; one person, one account,
  • complying with applicable law,
  • respecting the rights and dignity of others - no hate speech, harassment or discrimination.

2.3. Prohibited actions

  • posting content that is unlawful, offensive, vulgar or discriminatory,
  • infringing copyright or other third-party rights,
  • spam and unwanted messages,
  • attempts to gain unauthorised access to the Service or to breach its security,
  • posting false information about places,
  • using the Service for commercial purposes (advertising, affiliate links, sponsored content) without the Operator's prior written consent.

3. Plans and fees

3.1. Free and Pro plans

The Service is available in a free Free plan (automatically on registration) and a paid Pro plan. The scope of features is described on the pricing page.

3.2. Pro subscription

The Pro plan is a renewable monthly or annual subscription. The fee is charged upfront for the whole period, the subscription renews automatically unless you cancel it. You can cancel at any time in settings - access remains until the end of the paid period.

3.3. Payments

The seller and payment processor is Paddle (Paddle.com Market Limited) as Merchant of Record - it handles payment, invoices and taxes. All prices include applicable taxes; the final price is always shown at checkout. We never receive your card numbers.

3.4. Right of withdrawal (consumers)

As a consumer you generally have a 14-day right to withdraw from a distance contract. Under Art. 38(13) of the Polish Consumer Rights Act, for digital content this right does not apply if performance began with your explicit consent before the deadline. By buying Pro and requesting immediate access, you give such consent and acknowledge the loss of the right of withdrawal.

4. Registration and account

4.1. Registration

Registration is voluntary and free. We require a username, an e-mail address and a password. You activate the account via a link sent to the e-mail you provided. We do not offer login through social accounts - registration is only by e-mail.

4.2. Managing the account

You can edit your data in settings. You are responsible for the confidentiality of your password and for activity on your account; notify us immediately of any unauthorised access.

4.3. Deleting the account

You can delete your account in settings. After deletion your personal data is erased and the authorship of published content (place descriptions, reviews, comments, photos) is anonymised immediately (Art. 17 GDPR). Anonymised content stays in the Service as a contribution to the community knowledge base, shown without any link to your identity (for example “Anonymous user”).

5. Newsletter

The newsletter is free and voluntary, available without an account too. Consent to the newsletter is separate from registration - you give it during registration or in settings (Art. 6(1)(a) GDPR). The newsletter (sent on our behalf by an e-mail service provider, usually no more than twice a week) may include news, outdoor tips, featured spots and information about the Service's features.

You can unsubscribe at any time - via the link at the bottom of every message or in your account settings. After unsubscribing you will not receive further messages, and your address will be deleted without undue delay.

6. User content

6.1. What you can publish

You can publish: place descriptions and photos, reviews and opinions, comments, check-ins and posts in the community feed (text, photos, tags).

6.2. Requirements for content

Content must be lawful, true and reliable, must not infringe third-party rights (including copyright and personal rights), must be free of profanity, pornographic, graphic or violence-promoting content, and must relate to the outdoor topic.

6.3. Copyright and licence

You keep full copyright in the content you create.

You grant Wombato an irrevocable, worldwide and perpetual, free, non-exclusive licence to use, store, copy, modify, distribute, publicly display, adapt, translate, create derivative works from and commercially exploit the Content in any way, including in particular:

  • within the Wombato Service,
  • on social media (for example Facebook, Instagram) for promotional, marketing and advertising purposes,
  • in the Operator's marketing and advertising materials,
  • in press and online publications,
  • in the Service's promotional materials,
  • in the newsletter and other e-mail communications.

When we use your content in promotion, we mark it with your nickname or a note that it comes from the Wombato Service. You warrant that you hold full rights to the content you publish and that you do not infringe third-party rights.

6.3.1. Personal data in content

Your content (your image in photos, details in descriptions) may contain personal data. You publish it voluntarily and at your own responsibility. Do not upload photos with recognisable faces of other people without their consent. Photo metadata, including GPS, is removed automatically on upload.

6.3.2. Consent to use of image

Independently of the licence, you can give separate, voluntary consent in settings to the use of your image in the Operator's marketing materials. You can withdraw this consent at any time.

6.4. Managing content

You can edit reviews, comments and feed posts, and you can delete feed posts yourself. Because of the community nature of the Service, you cannot delete a published place yourself once it has been approved - in justified cases (the place no longer exists, breaks the law) submit a removal request; we will consider it within 14 days.

6.5. Moderation

Every newly added or edited place requires approval before publication. We may moderate, edit editorially, translate or remove content that breaches the Terms or the law, and restrict accounts in case of abuse. We will inform you of the decision with reasons and a right of appeal.

7. Information about the legal status of places

Nature of the information: place legality statuses are indicative only. They are not legal advice or a guarantee of legality.

Sources: the status is set automatically based on public spatial data (protected areas, official registers) or on community reports (marked as such). The data may be incomplete or out of date.

Your duty: before camping, always check the current local rules yourself - site regulations, the manager, temporary bans.

Liability: to the maximum extent permitted by law, Wombato is not liable for damage arising from relying on legality statuses (fines, penalties, third-party claims, financial losses). This does not limit consumer rights under mandatory law.

8. Leave No Trace and illegal places

By adding a place, you commit to the Leave No Trace principles: take your rubbish with you, respect nature and other people.

Places marked as illegal are shown only as a warning that camping there is prohibited. Wombato does not encourage breaking the law.

9. Reporting content

Every place, photo, review and comment has a report function - use it when you see an incorrect legality status, an infringement of rights or unlawful content. We handle reports within a reasonable time, aiming for 7 business days. You will receive a decision with reasons and the option to appeal. 10. Liability

10.1. User's liability

You are fully responsible for the content you publish and for holding the rights to it, for complying with the law and the Terms, for damage caused to others, and for the security of your account and password.

10.2. Operator's liability

We build Wombato with care, but the service is provided “as is”: we do not guarantee uninterrupted availability or that the information is fit for a particular purpose. Outdoor activity always involves risk - assess conditions on site and make your own decisions. We are not liable for content published by Users or for the quality of automatic translations.

10.3. Limitation of liability

No provision of the Terms limits liability that cannot be limited under the law, including for personal injury, for wilful misconduct or gross negligence, or mandatory consumer rights.

11. Intellectual property and data sources

All rights to the Service (graphics, code, the name “Wombato” and the logo) belong to the Operator and are protected. Copying and using the Service in a way that infringes these rights without written consent is prohibited.

Wombato uses public spatial data, including OpenStreetMap (© OpenStreetMap contributors, ODbL licence), the World Database on Protected Areas and national registers. The full list of sources and licences is available on the data attribution page in the Service.

12. Complaints and disputes

Submit complaints to support@wombato.com (a description of the problem plus identification details); we will consider them within 14 days. As a consumer you can use out-of-court dispute resolution, including the EU ODR platform (ec.europa.eu/consumers/odr).

The governing law is Polish law. Disputes with consumers are settled by the courts having jurisdiction under general rules.

13. Final provisions

The Terms may be changed for important reasons (a change in the law, new features, technical changes). We will announce changes in the Service or by e-mail at least 14 days in advance. Continued use after the changes take effect means you accept them; if you do not accept a change, you can delete your account before it takes effect.

The invalidity of any provision does not affect the validity of the others. The Terms are published in several languages - in case of any discrepancy, the Polish version prevails.
